The article examines the emerging in Kazakhstan of a new institution - family mediation, which includes 
legal norms. During the study, the author analyzes the basics of domestic and foreign literature. First of all, focusing 
on the theory of general mediation, focusing on the state of family mediation in modern Kazakhstan. At the same 
time, mediation and the role of the mediator in resolving family disputes in the pretrial order and its functions are 
considered. In particular, the focus is on family mediation in Kazakhstan based on the experience of mediation 
abroad. The author also claims that mediation in modern society is consistent with national values using traditional 
approaches. The legal framework is a comprehensive mechanism for family mediation as the primary mechanism. It 
also addresses the shortcomings and achievements of the legal framework for family mediation in the country and 
some social issues.
